The Intellectual Property Counsel will service Hospira's Pharma Intellectual Property (IP) requirements in a way that maximizes commercial value of products on a global basis through IP (eg. circumvent, challenge, create), facilitates timely decision making relating to patent issues and minimizes risk to the organization (where appropriate) within a global context. Will provide infringement and validity advice in line with relevant country laws. Be able to work with internal and external scientists/organizations/advisors to adopt and implement patent circumvention strategies and patent challenge strategies. Advise the business on risks and tactics with respect to litigation and opposition procedures. Manage global litigation, including global co-ordination and strategy. Will provide input to and if needed assist with the preparation of agreements that provide the relevant commercial benefit and protect the company from undue risk. Conduct searches and overview patent prosecution; implement strategies that are consistent with a proactive/aggressive approach with respect to patenting. Will also work closely with others in the IP group as well as those in the Commercial Group, Active Pharmaceutical Ingredient (API) Sourcing team, the Product Development group and Regulatory Affairs. Liaising regularly with senior managers, external lawyers and patent attorneys. Must understand and act in accordance with OH&S policy.
Skills/Experience Education/Certification Undergraduate and/or graduate science degree and law school (LL.B. or J.D.) degree are required. A combination of Science (chemistry or biotech) and law or patent attorney qualifications (Preferably law).
Experience in the pharmaceutical industry (highly preferable)
Previous experience in intellectual property is essential
Proven experience in assessing infringement and validity (re: patents) and giving related advice. Confidence to withstand probing questioning at a senior level (i.e. able to hold their ground). Ability to work with a variety of different people from scientists to senior managers to external lawyers. Attention to detail.
