BASIC PURPOSE: Provide guidance to the company in their efforts to develop and maintain legal/regulatory compliance policies and procedures with minimal customer service impact. Facilitate the relationship between legal, compliance, business, quality control and risk management; make sure there is fluid communication between these departments in order to avoid related risk. Ensure that quality control measures are in place in all phases of the mortgage process from pre-application to post-closing and secondary marketing.
GENERAL ACCOUNTABILITIES:
· Develop, and coordinate implementation of policies and procedures necessary to ensure compliance with applicable federal and state laws and regulations relating to the origination of consumer residential mortgage loans. Create related systems and procedures to ensure uniform compliance.
· Oversee the research and development of forms required for new or amended programs, including form changes mandated by the various state and federal agencies, as well as GSE's.
· Oversee governmental and state audits, branch evaluation processes, branch licensing, Fair Lending topics, HMDA reporting and FHA MWOB usage. Initiate, implement and monitor preventive and corrective actions; initiate, implement and monitor required modifications to procedures and practices (including technology and documentation).
· Perform internal audit reviews, including the review, documentation of audit findings and identification of causes or contributing factors relating to risk exposure. Provide recommendations to senior management based on audit findings.
· Ensure that branches are in compliance with agency, state and federal regulations and requirements. Monitor local, state and federal regulatory changes as they affect different operational departments; ensure that affected departments and personnel are immediately made aware of such changes. Work closely with corporate department managers to ensure compliant procedures and policies are in place and adhered to.
· Develop training to educate staff on relevant compliance issues.
· Take responsibility for annual HMDA reporting duties.
· Review trends of customer related inquiries or complaints made through internal processes and regulatory agencies to ensure that appropriate departments/individuals respond in a timely and appropriate manner with regard to compliance-related issues.
· Prepare written communication/recommendations to both company management and state and federal agency contacts.
REQUIREMENTS:
Bachelor's Degree or equivalent experience required plus a minimum of five years of compliance/operations management experience. Must possess knowledge of retail mortgage loan origination and processing and have strong, working knowledge of all mortgage forms from application to closing. Strong, working knowledge of Federal and state mortgage regulations required, as well as strong pc skills including advanced word processing and spreadsheet preparation abilities. Must also have broad mortgage compliance knowledge as it pertains to retail and wholesale mortgage banking, and thorough knowledge of TILA, RESPA, HMDA, HOEPA, GLB, FCRA, ECOA, state predatory or high cost lending, usury and licensing laws and regulations.
